Legal Education and Children’s Rights in Schools

Spring Term

Happy New Year! We hope you had a restful break, and you are feeling refreshed for the start of a new term.

In each newsletter we aim to highlight ongoing work in children’s rights that is of particular relevance in education settings.

The Children’s Legal Centre Wales is a Wales-wide, bilingual service providing information for children and young people.

    Our main aims are to:

    • Provide training and education on the law as it affects children and young people.

    • Carry out research, data analysis and evaluative studies to change and improve law, policy and practice in relation to children and young people.

     

    We also:

    • Offer training and other help to schools, community groups and professionals

    • Organise conferences, workshops and seminars

    • Support networks that help spread knowledge about children’s human rights and the law in Wales.

    Different in Wales Campaign and Competition

     

    FINAL Diff in Wales

    In Wales, the law is sometimes different than the laws in the rest of the UK.

    This is because the UK Government has given power to the Senedd (and to the Scottish Parliament and the Northern Ireland Assembly) to make some of its own laws. The law is different in lots of the areas that affect children and young people, including education, health and social care.

    It is also different because the Welsh Government recognises the United Nations Convention on the Rights of the Child (UNCRC).

     

    The Children’s Legal Centre Wales has created an infographic that highlights some areas of law that are different in Wales that are relevant to young people.

     

    We are asking schools to get involved in helping us share this resource by taking part in our ‘Expressive Art’ competition.

    Article 13: I have the right to get information and share my views.

    The child shall have the right to freedom of expression; this right shall include freedom to seek, receive and impart information and ideas of all kinds, regardless of frontiers, either orally, in writing or in print, in the form of art, or through any other media of the child’s choice

    World Book Day

    March 6th brings us World Book Day. This year, the Reading My Rights blog project has focused on writing blogs based on texts that are included in the English Literature GSCE syllabus.

    The aim is to develop young people’s legal education through analysing the texts and making links to law and Children’s Rights. Text that have been covered so far include;

    • Never Let Me Go

    We are continuously building this library of blogs, so keep checking in for new additions. These blogs can be used as a starting point for class discussions or looking at alternative viewpoints. They will also help enhance the teaching of Human Rights, which is a Cross Cutting Theme in The Curriculum for Wales.

    We would love to hear your pupil’s views or how you are using the blogs.

    Article 42: Everyone should know about children’s rights.

    States Parties undertake to make the principles and provisions of the Convention widely known, by appropriate and active means, to adults and children alike.

    Safer Internet Day

    Sexting is an issue that can affect young people, and many are unaware of the laws around sending and receiving nude or semi-nude images. The Children’s Legal Centre Wales are working to create a resource bank for education professionals, as well as information aimed at young people, informing them of their legal rights.

    Article 16: I have the right to keep some things private.

    No child shall be subjected to arbitrary or unlawful interference with his or her privacy, family, home or correspondence, nor to unlawful attacks on his or her honour and reputation.

     

    The child has the right to the protection of the law against such interference or attacks.

    Legal Education Resource Development

    This year we will carry out a pilot project with three secondary schools in Swansea where we will be trialing a bank of resources based on issues that affect children and young people. The issues were identified during the initial pilot project in 2024, and will cover;

    1. Knife Crime
    2. Sexting/ Sexploitation
    3. Vaping and Addictive Substances
    4. Mental Health
    5. Cost of Living (Benefits, Free School Meals, Universal Uniform Grant)
    6. Relationships (Family and Personal)
    7. Identity
    8. Environment and Pollution
    9. Contact with the Police

     

    Our resource banks will be published on our website later this year.

    Article 40: I have the right to be treated as a child
    if I break the law

     

    States Parties recognize the right of every child alleged as, accused of, or recognized as having infringed the penal law to be treated in a manner consistent with the promotion of the child’s sense of dignity and worth, which reinforces the child’s respect for the human rights and fundamental freedoms of others and which takes into account the child’s age and the desirability of promoting the child’s reintegration and the child’s assuming a constructive role in society

     Children’s Mental Health Week 

    Children’s Mental Health Week 2025 will take place from 3rd to the 9th of February 2025. According to Mind Cymru, Wales is facing a mental health emergency. Waiting lists are far too long and our mental health system is failing those most in need.

     

    The Children’s Legal Centre Wales is calling for changes

    Prioritise investment in child mental health via prevention, early intervention and crisis services for children.

    Ensure there is a ‘No Wrong door’ and a holistic Children’s Rights Approach to mental health support and services for children.

    States Parties recognize the right of the child to the enjoyment of the highest attainable standard of health and to facilities for the treatment of illness and rehabilitation of health. States Parties shall strive to ensure that no child is deprived of his or her right of access to such health care services

    Additional Learning Needs

    The Additional Learning Needs and Education Tribunal (Wales) Act 2018 sets out what schools should be doing to support children with Additional Learning Needs in Wales.

    Article 23: If I am disabled, I have the right to special care and education.

    States Parties recognize that a mentally or physically disabled child should enjoy a full and decent life, in conditions which ensure dignity, promote self-reliance and facilitate the child’s active participation in the community.

     

    States Parties recognize the right of the disabled child to special care and shall encourage and ensure the extension, subject to available resources, to the eligible child and those responsible for his or her care, of assistance for which application is made and which is appropriate to the child’s condition and to the circumstances of the parents or others caring for the child

    Mae Canolfan Gyfreithiol y Plant, Cymru yn wasanaeth dwyieithog sy’n rhoi gwybodaeth i blant a phobl ifanc ledled Cymru.

     

         Ein prif amcanion yw:

          • Darparu hyfforddiant ac addysg ar y gyfraith fel y mae'n effeithio ar blant a phobl ifanc.

        Ar adegau mae’r gyfraith yng Nghymru yn gallu bod yn wahanol i’r deddfau yng ngweddill y DU.

        Y rheswm am hyn yw bod Llywodraeth y DU wedi rhoi pŵer i Senedd Cymru (a Senedd yr Alban a Chynulliad Gogledd Iwerddon) i lunio rhai o’i deddfau ei hun. Mae’r gyfraith yn wahanol mewn llawer o’r meysydd sy’n effeithio ar blant a phobl ifanc, gan gynnwys addysg, iechyd a gofal cymdeithasol.
